BlueCart Connect, LLC takes the protection of its intellectual property very seriously. We have secured multiple forms of intellectual property for the BlueCart™ telehealth system. Unauthorized use or infringement of our patents, trademarks, trade dress, or copyrighted material is strictly prohibited and will be pursued. Below we outline our specific rights:
1.1 Patents
BlueCart™ is protected by U.S. Patent No. 12,015,852 B2, with additional patents pending. This patent covers key innovations in the BlueCart telehealth cart. Any products or systems that incorporate BlueCart’s patented features without authorization are an infringement of our patent rights. BlueCart Connect will vigorously enforce its patent portfolio to the fullest extent of the law.
1.2 Trademarks
BlueCart™ is a trademark of BlueCart Connect, LLC (USPTO status: live/accepted). The BlueCart name and logo represent our brand and may not be used by others without our permission. Any unauthorized use of the “BlueCart” name or any similar mark to market or promote products is strictly prohibited. We will enforce our trademark rights to prevent confusion and protect our brand’s identity.
1.3 Trade Dress
The unique blue color, as well as the distinctive shape, silhouette, and configuration of the BlueCart device’s camera enclosure and power-supply cover, constitute the proprietary trade dress of BlueCart Connect, LLC. This means the overall look and design of the BlueCart hardware is legally protected as a brand identifier of our company. Imitation of BlueCart’s appearance (such as producing a telehealth cart with a confusingly similar blue color and/or design) would violate our trade dress rights. We are prepared to enforce these rights against any copycat designs.
For reference, the BlueCart™ device’s distinctive design as shown in the image to the right highlights its signature blue camera housing at the top and the matching blue base cover. This design configuration – especially the unique blue color and the shape of those components – is claimed as part of BlueCart Connect’s trade dress (its protected product look-and-feel). By publicly identifying these features, BlueCart Connect signals that it will defend this distinctive look against any imitators. Competitors should be aware that any product with a confusingly similar appearance could violate our trade dress rights.
